360Rent - General Terms of Service
(Module 1 – applies to all users)

These Terms of Service (“Terms”) set out the agreement between 360Rent Ltd (“360Rent”, “we”, “our”, “us”) and you (“User”, “you”, “your”) governing your use of the 360Rent platform, mobile app and related services (together, the “Platform”).
By creating an account or using the Platform, you agree to these Terms.
1. Eligibility & Account Registration
- You must be at least 18 years old to use the Platform.
- You must register an account, provide accurate and up-to-date information, and choose your main purpose for using the Platform (Landlord, Tenant, or Contractor).
- You are responsible for maintaining the security of your account and password.
2. Role of 360Rent
- 360Rent is a technology platform that allows landlords, tenants and contractors to connect, communicate and manage letting-related activities.
- We are not a party to any tenancy agreements, service contracts or employment relationships formed through the Platform.
- You remain solely responsible for complying with your legal obligations under:
- The Housing Act 1988 and subsequent amendments
- The Housing and Planning Act 2016
- Relevant landlord–tenant legislation in England and Wales
- Industry best practices including ARLA standards
3. Acceptable Use
You agree not to:
- Use the Platform for unlawful, misleading or fraudulent purposes
- Post or upload content that is abusive, defamatory, or violates the rights of others
- Circumvent security measures or attempt to gain unauthorised access
- Use the Platform to harass, threaten or abuse other users
We may suspend or terminate your account if you breach these Terms.
4. AI Tools & Advice
- The Platform may provide AI-generated guidance or document templates based on publicly available laws, regulations, and industry standards.
- AI advice is for informational purposes only and does not constitute legal or financial advice.
- You must verify any guidance before acting on it. 360Rent is not liable for errors or omissions in AI-generated content.
5. Contractors & Insurance
- Contractors using the Platform must hold appropriate public liability insurance and any licences or certifications required by law.
- Landlords and tenants are responsible for verifying a contractor’s credentials before engaging them.
6. Communication Tools
- Users may communicate with each other through in-app messaging and notifications.
- You must use these tools respectfully and solely for property-related purposes.
7. Disputes Between Users
- 360Rent is not a party to disputes between users and has no obligation to intervene.
- The Platform may provide automated FAQs or AI guidance referencing the Housing Act or ARLA standards to help resolve issues, but this is not binding or enforceable advice.
8. Content & Intellectual Property
- You retain ownership of content you upload to the Platform.
- You grant 360Rent a non-exclusive licence to store, display and transmit your content as needed to operate the Platform.
- All intellectual property in the Platform (design, code, trademarks, branding) belongs to 360Rent Ltd.
9. Liability
- The Platform is provided “as is” and “as available”.
- To the fullest extent permitted by law, 360Rent disclaims all warranties and will not be liable for:
- Loss of profits, business, data, or reputation
- Any indirect, incidental, or consequential damages
- Disputes, losses, or harm arising from user interactions or agreements
10. Termination & Suspension
- You may close your account at any time.
- We may suspend or terminate your account if you breach these Terms or misuse the Platform.
- Upon termination, your access to the Platform and any stored data may be removed.
11. Changes to These Terms
- We may update these Terms from time to time.
- We will notify users of significant changes via the Platform or by email.
- Continued use after changes constitutes your acceptance of the new Terms

12. Governing Law
- These Terms are governed by the laws of England and Wales.
- The courts of England and Wales shall have exclusive jurisdiction over any disputes arising under these Terms.

360Rent — Financial Services Addendum
(Module 2 – applies only when users use payment or financial features)

This Financial Services Addendum (“Addendum”) supplements the 360Rent General Terms of Service. By accessing or using any payment, rent collection, deposit handling or other financial services (“Financial Services”) through the Platform, you agree to this Addendum.
1. Third-Party Payment Processor
- All Financial Services are provided by a third-party payment processor (“Payment Provider”) that is authorised and regulated by the UK Financial Conduct Authority (FCA).
- 360Rent does not collect, hold, or control client money at any time.
- By using Financial Services, you agree to the Payment Provider’s separate Terms of Service and Privacy Policy, which will be made available to you before using their services.
2. User Obligations
- You must provide accurate payment and bank account details when using the Financial Services.
- You authorise the Payment Provider to process payments, transfers, or collections on your behalf.
- You are responsible for paying any applicable transaction fees or charges disclosed by the Payment Provider.
3. Disputes and Chargebacks
- 360Rent is not responsible for and will not mediate disputes regarding payments, failed transfers, refunds, or chargebacks.
- All such disputes must be raised directly with the Payment Provider and/or your bank or card issuer.
4. Regulatory Compliance
- You acknowledge and agree that:
- The Payment Provider is responsible for FCA compliance and safeguarding client funds
- 360Rent is not authorised by the FCA and does not carry out any regulated financial activity
- Your use of the Financial Services must comply with all applicable financial crime, anti-money laundering (AML), and counter-terrorist financing (CTF) laws
5. Limitation of Liability
- To the maximum extent permitted by law, 360Rent shall not be liable for:
- Loss or delay of payments
- Payment disputes or reversals
- Unauthorised transactions or fraud occurring through the Payment Provider’s systems
6. Termination
- 360Rent may suspend or disable your access to Financial Services if:
- Required by law or regulation
- Instructed to do so by the Payment Provider
- We reasonably believe your use is fraudulent or unlawful
7. Governing Law
- This Addendum is governed by the laws of England and Wales.
- The courts of England and Wales have exclusive jurisdiction over any dispute arising under this Addendum.

360Rent — Document & Data Storage Addendum
(Module 3 – applies to users storing documents or data)

This Document & Data Storage Addendum (“Addendum”) supplements the 360Rent General Terms of Service. By uploading or storing documents, data, or other content on the Platform (“Content”), you agree to this Addendum.
1. Use of Cloud Storage
- The Platform uses secure third-party cloud storage providers to store Content uploaded by users.
- The identity of the cloud provider may change, but 360Rent will ensure any provider used applies appropriate industry-standard security measures.
2. Ownership and Licensing
- You retain full ownership of all Content you upload.
You grant 360Rent a limited, non-exclusive licence to host, store, display and transmit your Content only as necessary to operate the Platform.
3. Security
- 360Rent implements reasonable technical and organisational measures to protect Content.
- However, no system is completely secure and 360Rent cannot guarantee absolute protection from unauthorised access or data breaches.
4. Responsibilities
- You are responsible for ensuring your Content does not:
- Violate any laws or third-party rights
- Include unlawful or offensive material
- You must maintain your own backup copies of important Content.
5. Retention and Deletion
- Content will be retained while your account is active.
- Upon account deletion or written request, Content will be permanently deleted within a reasonable period, unless we are legally required to retain it.
6. Liability
- 360Rent is not liable for loss, corruption, or unauthorised disclosure of Content where industry-standard security practices have been followed.
7. Governing Law
- This Addendum is governed by the laws of England and Wales, with jurisdiction in its courts.
360Rent — AI Tools & Legal Document Generation Addendum
(Module 4 – applies to users who use AI tools)

This AI Tools & Legal Document Generation Addendum (“Addendum”) supplements the 360Rent General Terms of Service. By using any AI-generated guidance, templates or documents (“AI Tools”), you agree to this Addendum.
1. Advisory Nature
- AI Tools may provide:
- Suggested tenancy agreements and forms
- Guidance based on the Housing Act 1988 and other applicable UK housing law
- Summaries of ARLA standards or best practices
- These outputs are automatically generated and for informational purposes only.
2. No Legal or Financial Advice
- 360Rent does not provide legal, financial, or professional advice.
- You must review and, where appropriate, seek professional advice before relying on any AI Tool outputs.
3. Accuracy and Updates
- AI Tools are updated periodically to reflect current law and standards.
- 360Rent does not guarantee that outputs are complete, accurate, or up-to-date at the time of use.
4. Liability Disclaimer
- 360Rent is not responsible for any errors, omissions, or losses arising from the use of AI Tool outputs.
5. Intellectual Property
- Any document generated by AI Tools is provided to you under a non-exclusive licence.
- 360Rent retains rights in the underlying AI models and systems.
6. Governing Law
- This Addendum is governed by the laws of England and Wales, with jurisdiction in its courts.
360Rent — Privacy Policy
(Module 5 – applies to all users)

This Privacy Policy explains how 360Rent Ltd (“360Rent”, “we”, “us”, “our”) collects, uses, stores and protects your personal information when you use our Platform.
1. Information We Collect
We may collect:
- Account information: name, email, phone number, password
- Identity information: proof of ID/address (if required by payment or referencing partners)
- Property and tenancy information you upload (e.g. tenancy agreements, certificates)
- Payment information (processed via third-party Payment Provider, not stored by us)
- Communication data (messages, support requests)
- Technical data (device, browser, log data, cookies)
2. How We Use Your Data
We use your personal data to:
- Create and manage your account
Provide platform features (messaging, document storage, listings, etc.) - Facilitate payments via our Payment Provider
- Provide AI-generated tools and guidance
- Maintain security and prevent fraud
- Comply with our legal obligations
3. Legal Basis for Processing

360Rent — Data Protection Agreement (DPA)
(Module 10 – incorporated into the Terms of Service for all users)

This Data Protection Agreement (“DPA”) forms part of the 360Rent Terms of Service. It governs the processing of personal data submitted, stored, or otherwise processed through the 360Rent platform (“Platform”) in connection with property management activities.
1. Definitions For the purposes of this DPA:
- Controller: the party who determines the purposes and means of processing personal data (typically landlords when managing their tenants’ data)
- Processor: the party who processes personal data on behalf of the Controller (360Rent when providing Platform services)
- Data Subject: any individual whose personal data is processed (e.g. tenants, landlords, contractors)
- Personal Data: any information relating to an identified or identifiable natural person
- Applicable Data Protection Law: the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018
2. Roles and Responsibilities
- When a user uploads, inputs, or otherwise provides personal data about third parties (e.g. tenants), that user is the Controller, and 360Rent acts as Processor.
When users register their own accounts, 360Rent acts as a Controller of their personal data (see Privacy Policy).
3. Processing Instructions
- 360Rent shall process personal data only on documented instructions from the Controller, as necessary to provide the Platform services.
- 360Rent shall not use the data for any other purpose and shall not disclose data except as instructed or required by law.
4. Confidentiality
- 360Rent shall ensure that all personnel authorised to process personal data are subject to appropriate confidentiality obligations.
5. Security Measures
- 360Rent shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including (where appropriate):
- encryption of data in transit and at rest
- secure authentication and access controls
- regular security assessments and patching
- logical separation of customer data
6. Sub-Processors
- 360Rent may engage third-party sub-processors (e.g. cloud hosting providers, financial plug-ins) to provide parts of the services.
- A current list of sub-processors will be made available on request.
- 360Rent will ensure sub-processors are bound by written agreements with equivalent data protection obligations.
7. Data Subject Rights
- 360Rent shall, to the extent legally permitted, assist Controllers in responding to data subject requests (access, rectification, erasure, portability, restriction or objection).
- Controllers are responsible for verifying the identity and legitimacy of any data subject request.
8. Data Breach Notification
- 360Rent shall notify Controllers without undue delay upon becoming aware of a personal data breach affecting their data.
- Such notification will include details of the breach, its impact, and any steps taken or proposed to mitigate it.
9. Data Retention and Deletion
- Upon termination of a user’s account, 360Rent will:
- delete or return personal data to the Controller on request, and
- delete all remaining copies from active systems within [30] days (unless legal obligations require longer retention).
- Backup copies will be securely destroyed after their scheduled lifecycle expires.
10. International Transfers
- 360Rent will not transfer personal data outside the UK without ensuring adequate safeguards in accordance with UK GDPR (e.g. UK International Data Transfer Agreement).
11. Audits
- On reasonable notice, 360Rent will provide Controllers with information necessary to demonstrate compliance with this DPA.
- If required by law, 360Rent will allow audits by regulators or their designees, subject to confidentiality obligations.
12. Governing Law
- This DPA shall be governed by and construed in accordance with the laws of England and Wales.
- The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising under this DPA.
